TERMS OF SERVICE FOR PRIVATE COMMISSIONS

By commissioning me, you agree to my terms of service.

1.- GENERAL TERMS 

I have the right to refuse any order that I do not feel comfortable placing for any reason.

 All drawings will include a subtle signature that you cannot remove.

2.- PAYMENT 

The means of payment is through PayPal invoice.

 

Commissions can be paid 100% up front or split 50% up front and 50% after sketch approval.

 

Do not send me any payment before I have agreed to give you a space and asked you to send me payment.

3.- PROCESS & DELIVERY 

The time it takes to complete each commission varies from approximately 1 week to 2 weeks, depending on factors such as health, complexity of the commissioned piece, other jobs and seasons.

 

While I'm working on your commission, I'll check in with you to make sure I'm doing it right for you.

 

If something comes up that will delay the progress of the initially estimated delivery time, I will let you know as soon as possible.

 

Once the piece is finished, it can be sent via Gmail for better quality.

4.- REVISIONS 

During the sketch you are free to suggest any neccesary changes. During lineart you get 3 rounds of changes before coloring begins, once exceeded, an additional fee will be charged (a fee will not be charged if it is a detail that the artist forgot or misinterpreted).

5.- COPYRIGHTS AND USE

I, Katzumi Chan (the artist):

 

  • I retain all copyrights to the commissioned artwork.

  • I reserve the right to cancel and refund the order at any time and for any reason.

  • I will NOT benefit further from the commissioned artwork unless you (the client) violate any of the terms. 

 

You (the client/commissioner):

 

  • You can upload the commissioned artwork on any website and social channels.

  • You may NOT make a profit from the commissioned piece (resell, redistribute, upload to POD services, make prints, etc.)

  • You may NOT alter the commissioned artwork without my (the artist's) consent.

  • You MAY be allowed to sell the artwork if it is part of an Adoptable. Please discuss this with me prior to paying for the artwork.

  • You may NOT use the commissioned artwork for commercial purposes, unless an agreement is reached.

 

The following is considered copyright infringement:

 

  • Commercially reproducing/using the copyrighted artwork means making money from it in any way, without an agreement.

  • Claim the artwork as your own.

  • Remove my signature from the artwork.

  • Alter the artwork without my consent.

6.- CUSTOMER SATISFACTION

I will do my best to make my customers happy!

 

If you have any problems related to the ordered part, tell me immediately so that we can find a solution together.

7.- CANCELLATION AND REFUND POLICY

The buyer is not allowed a refund once payment is received. Please make sure you agree to ask me for a commission.

 

If for any reason I am unable to initiate your commission, you will receive a full refund.

 

If you are receiving a refund, please do not request a Paypal chargeback. I'll pay you back myself.

 

If you request a Paypal chargeback at any time that you were not allowed to request a refund, you will lose all rights listed above to the ordered part and I will have every right to additional profit in any way. I will decline the chargeback and provide Paypal with our conversations in which we discussed the commission as proof that I have completed the work for you. Plus, you'll be blacklisted for ordering me again.

Sketch that you must accept before I continue the work.

 

Insight and involvement in color plan (depending on the complexity of the commissioned piece).

Full-resolution file (approx. 1600 x 1600 px at 72 DPI) of final drawing. Final file formats are usually PNG.
